Allianz mulls appeal over “cost of repair” ruling


Allianz says its legal team is considering a judgement made by Mr Justice Cooke last week regarding the practice of producing invoices to prove claims for cost of repair.


According to the insurer, if the judgement stands, insurers tempted to seek recovery based upon diminution of value, rather than the traditional repair cost, will have to produce evidence other than a repair invoice (possibly an engineer’s report).


Allianz argues that this could result in challenge, dispute, additional cost and delayed recovery and may therefore not be good news for the premium paying public, the industry, or the customer waiting to have their claim settled.


The group has 21 days to apply to the Court of Appeal for permission to appeal against the judgement and says it is currently reviewing this option.
